Talent Partner Terms & Conditions

1. Introduction

These Terms & Conditions govern the collaboration between Juucy Software GmbH ("Juucy" or "Provider") and independent recruiters ("Talent Partner"). By signing up on Juucy’s platform, Talent Partners agree to the terms outlined below. This agreement ensures a transparent, efficient, and rewarding recruitment process for all parties.

2. About Juucy

Juucy is a marketplace that connects independent (freelance) recruiters with companies seeking top talent. Our mission is to empower recruiters by eliminating client acquisition hurdles, enabling them to focus on sourcing and nurturing candidate relationships.

3. Talent Partner Benefits

  1. Access to Top Clients – Work with vetted companies without customer acquisition efforts.
  2. Optimized Sourcing – Utilize Juucy’s platform, branding, and tools to speed up recruitment.
  3. Attractive Incentives – Earn interview fees, placement fees, and speed bonuses for early submissions.

4. Roles & Responsibilities

4.1 Talent Partner Responsibilities

  • Sourcing and submitting qualified candidates.
  • Conducting initial candidate briefings and pre-qualification interviews.
  • Ensuring accuracy of candidate data (CV, salary expectations, availability, notice period, cultural fit, etc.).
  • Using Juucy's Applicant Tracking System (ATS) for all candidate submissions.

4.2 Juucy’s Responsibilities

  • Forwarding candidates to clients and ensuring transparency in hiring processes.
  • Gathering feedback and maintaining up-to-date hiring statuses.
  • Communicating rejections, interview schedules, and hiring decisions.

5. Fee Structure & Payments

5.1 Compensation Breakdown

  • Interview Fee – €50-€200 per first interview attended by the candidate.
  • Placement Fee – Typically 15%-20% of the candidate’s annual gross salary, with a 50/50 revenue share between Juucy and the Talent Partner (+ Loyalty Level Factor).
  • Speed Bonus – Additional €200 for candidates submitted within 3 days of job launch.

5.2 Payment Process

  • Interview Fees – Processed monthly with a one-month delay.
  • Placement Fees – 50% paid at contract signing or employment start date, 50% after the probationary period.
  • Loyalty Program – Talent Partners can increase their revenue share up to 60% through performance-based levels.

5.3 Candidate Ownership & Fee Eligibility

  • Talent Partners retain candidate ownership for six months after submission.
  • If a candidate is hired within this period, the Talent Partner is entitled to a placement fee.
  • If another recruiter actively re-engages the candidate, the ownership may be reassigned.

5.4 Invoice & Payment Terms

  • Juucy informs Talent Partners within 14 days of due fees.
  • Talent Partners must invoice Juucy promptly. Payment is made within 14 days of a valid invoice.
  • Fees are net amounts, with applicable VAT added where necessary.

6. Loyalty Program

Juucy typically charges companies a success fee equivalent to the candidate’s gross monthly salary. As a Talent Partner, you can earn up to (50/50) + 20% of this fee based on your performance with juucy. The structure is as follows:

  • Level 0: Talent Partner is newly registered with Juucy and starts working on their first placement – The fee displayed on the Job Board is already net and accounts for the default split (Juucy = 50% / Talent Partner = 50%).
  • Level 1: From the 2nd successful placement (at least 1 successful hire) → Standard Fee (50/50) + 5%.
  • Level 2: From the 4th successful placement (at least 3 successful hires) → Standard Fee (50/50) + 10%.
  • Level 3: From the 7th successful placement (at least 6 successful hires) → Standard Fee (50/50) + 15%.
  • Level 4: From the 11th successful placement (at least 10 successful hires) → Standard Fee (50/50) + 20%.

The commission displayed on the Job Board already reflects the Talent Partner’s level and shows the final net earnings for a successful placement.

7. Exclusivity & Withdrawal Conditions

  • Exclusive Role Access – Certain roles may have a two-week exclusivity period.
  • Performance-Based Extensions – Extensions may be granted based on performance.
  • Withdrawal of Exclusivity – If performance does not meet expectations, exclusivity may be revoked.

8. Platform Guidelines & Prohibited Activities

Talent Partners must uphold professionalism and platform integrity. The following activities are strictly prohibited:

  • Contacting candidates before being assigned a role on Juucy.
  • Spamming candidates or re-engaging those who have expressed disinterest.
  • Misrepresenting client details or sharing false information.
  • Ignoring job briefing notes or hiring manager instructions.
  • Failing to adhere to client-provided feedback and hiring criteria..

Non-compliance may result in account suspension or termination.

9. Candidate Tracking & Assignment

Candidates are assigned to Talent Partners via:

  • ATS Upload – Automatic assignment through profile submission.
  • Self-Application – Candidates applying after referral by a Talent Partner.
  • Database Registration – If a Talent Partner registers a candidate in Juucy's system and they later apply.

If no assignment is clear, candidates must confirm recruiter involvement before signing an employment contract.

10. Contract Duration & Termination

  • The agreement begins upon registration or signing the Cooperation Agreement.
  • Either party may terminate the agreement with four weeks' notice.
  • Termination must be in writing (including digitally signed PDFs via email).
  • Upon termination, the Talent Partner must return any Juucy property and delete confidential data.

11. Non-Solicitation & Third-Party Activities

  • Talent Partners must not solicit Juucy’s clients for direct business during and 12 months after contract termination.
  • If working with competing platforms, Talent Partners must disclose this to Juucy.

12. Confidentiality & Data Protection (GDPR Compliance)

  • Talent Partners must maintain confidentiality regarding Juucy’s clients, processes, and candidate data.
  • Data may not be shared, sold, or disclosed without explicit permission.
  • Talent Partners must implement appropriate technical and organizational measures to prevent unauthorized access to personal data, in accordance with GDPR Article 32.
  • Any data breaches must be reported immediately to Juucy.
  • If subcontractors are used, they must comply with GDPR and be pre-approved by Juucy.

13. Liability & Dispute Resolution

  • Juucy is not liable for unfulfilled hiring processes, external factors affecting recruitment, or candidate withdrawals.
  • In the event of a dispute over candidate ownership or placement fees, Juucy will make the final decision based on platform records.
  • The exclusive place of jurisdiction for all disputes arising under this agreement is Berlin, Germany.

14. Final Provisions

  • Talent Partners must be at least 18 years old.
  • This agreement supersedes all previous agreements between Juucy and the Talent Partner.
  • Amendments must be made in writing.
  • If any provision is found to be invalid, it does not affect the validity of the remaining provisions.
